These Terms of Service ("Terms") govern your access to and use of the RITE mobile application and website (collectively, the "Service") operated by RITE ("we," "us," or "our"). By creating an account or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old to use the Service. By agreeing to these Terms you represent that you are 18 or older and have the legal capacity to enter into a binding agreement. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at support@rite-app.com if you suspect unauthorized access. We are not liable for losses caused by unauthorized use of your account.
You may not create accounts using automated means, create accounts under false identities, or create multiple accounts to circumvent restrictions.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:
You retain ownership of content you submit ("User Content"). By submitting User Content you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, display, and distribute it solely for the purpose of operating and improving the Service.
We use automated content moderation to screen uploaded videos. Content that violates these Terms may be rejected or removed, and repeat violations may result in account suspension or termination.
You represent and warrant that you own or have the necessary rights to the User Content you submit and that it does not violate any third-party rights or applicable laws.
Nature of wagers. RITE allows users to place in-app wagers on the outcomes of RITEs and other community competitions using a credits-based system. Wagers are entertainment features designed to increase accountability and community engagement.
Credits. Credits ("RITE Credits") may be purchased through the app or earned through platform activity. Credits have no cash value unless explicitly converted through our cash-out feature, subject to the conditions below. Credits are non-transferable and may not be sold, gifted, or traded outside the Service.
Cash-outs. Users who meet eligibility requirements (minimum balance, identity verification if required, and account standing) may request a cash-out of credit balances. Cash-out requests are subject to a processing review. We reserve the right to decline cash-out requests if we have reason to believe credits were obtained through fraud, abuse, or violation of these Terms.
Platform fee. We charge a platform fee of up to 5% on pot payouts. This fee is disclosed before you place a wager.
No guarantee of outcome. Wager outcomes are determined by community activity and the rules of each RITE. We do not guarantee any particular outcome or return. Credits placed in wagers may be lost.
Eligibility. Wager features are available only in jurisdictions where permitted by law. You are solely responsible for determining whether participation is lawful in your jurisdiction. We may restrict or disable wager features in certain regions.
Certain features, including the Founder's Circle membership and paid subscriptions, are available for purchase. Payments are processed by Stripe. By providing payment information you authorize us to charge the applicable fees.
Subscriptions renew automatically unless cancelled before the renewal date. You may cancel at any time from your account settings. Refunds are handled in accordance with our refund policy and, where applicable, the policies of the applicable app store (Apple App Store or Google Play).
Paid members receive a 1.25x bonus on rank point gains as described in the app.
If you purchase credits or subscriptions through the Apple App Store or Google Play, those purchases are subject to the respective store's terms and refund policies in addition to these Terms. We do not process refunds for purchases made through the stores directly — please contact Apple or Google for refund requests.
The Service, including its design, logos, text, graphics, and software, is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent.
The Service integrates with third-party platforms including Stripe, Cloudinary, Google, Apple, and Firebase. Your use of those services is governed by their respective terms and privacy policies, which are separate from these Terms.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
TO THE FULLEST EXTENT PERMITTED BY LAW, RITE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF $100 USD OR THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless RITE and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, or your violation of these Terms.
We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion, with or without notice. You may delete your account at any time from the app settings. Upon termination, your right to use the Service ceases immediately. Sections 8, 10, 11, 12, and 14 survive termination.
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If not resolved within 30 days, disputes shall be resolved by binding individual arbitration under the JAMS rules, and you waive any right to participate in a class action lawsuit or class-wide arbitration. Notwithstanding the foregoing, either party may seek injunctive relief in a court of competent jurisdiction.
We may update these Terms from time to time. If we make material changes we will provide notice via email or an in-app message at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
